自動(dòng)駕駛機(jī)動(dòng)車交通事故侵權(quán)責(zé)任主體研究

摘 要：近年來(lái)，人工智能的熱潮席卷全球，自動(dòng)駕駛作為人工智能的標(biāo)志性應(yīng)用之一，毫無(wú)疑問(wèn)將會(huì)帶來(lái)巨大的社會(huì)效益。但是多起自動(dòng)駕駛事故也警示我們應(yīng)重視由自動(dòng)駕駛機(jī)動(dòng)車所引發(fā)的侵權(quán)問(wèn)題。立足于自動(dòng)駕駛的特性以及分級(jí)，來(lái)分析不同等級(jí)的自動(dòng)駕駛機(jī)動(dòng)車導(dǎo)致的交通事故中，損害賠償責(zé)任主體的認(rèn)定問(wèn)題。

Research on the Subject of Tortious Liability for Autonomous Vehicle Traffic Accidents

Abstract：In recent years， the boom of artificial intelligence has swept the world， and autonomous driving， as one of the iconic applications of artificial intelligence， will undoubtedly bring huge social benefits. However， a number of autonomous driving accidents also warn us that we should pay attention to the infringement caused by autonomous vehicles. Based on the characteristics and classification of automatic driving， the article will analyze the identification of the subject of damage compensation liability in traffic accidents caused by different levels of autonomous vehicles.

1 自動(dòng)駕駛機(jī)動(dòng)車概述

1.1 自動(dòng)駕駛機(jī)動(dòng)車的概念及特性

根據(jù)《智能汽車創(chuàng)新發(fā)展戰(zhàn)略》（征求意見(jiàn)稿），智能汽車是指通過(guò)搭載先進(jìn)傳感器、控制器、執(zhí)行器等裝置，運(yùn)用信息互通、互聯(lián)網(wǎng)、大數(shù)據(jù)、云計(jì)算、人工智能等新技術(shù)，具有部分或完全自動(dòng)駕駛功能，由單純交通運(yùn)輸工具逐步向智能移動(dòng)空間轉(zhuǎn)變的新一代汽車。（剩余4939字）
