論網(wǎng)絡(luò)虛擬財(cái)產(chǎn)的物權(quán)屬性

——技術(shù)保護(hù)可能性的初探

摘要：因網(wǎng)絡(luò)虛擬財(cái)產(chǎn)物權(quán)說(shuō)難以解釋網(wǎng)絡(luò)虛擬財(cái)產(chǎn)在技術(shù)上的不確定性，故筆者著眼于一種新興的區(qū)塊鏈技術(shù)應(yīng)用，以技術(shù)保護(hù)的視角來(lái)論證網(wǎng)絡(luò)虛擬財(cái)產(chǎn)物權(quán)屬性，提出新技術(shù)下虛擬財(cái)產(chǎn)保護(hù)可能存在的更優(yōu)模式。

On the Property Right Attribute of Network Virtual Property

--A Preliminary Probe into the Possibility of Technical Protection

Abstract： Due to network virtual property rights， it is difficult to interpret network virtual property in technology uncertainty， and the author focuses on an emerging block chain technology application， with technical imports to demonstrate network virtual property rights attributes， and propose new technology to virtual property.

0  引言

據(jù)我國(guó)《民法總則》在立法過(guò)程中有關(guān)網(wǎng)絡(luò)虛擬財(cái)產(chǎn)的討論，與《民法總則》正式通過(guò)后有關(guān)網(wǎng)絡(luò)虛擬財(cái)產(chǎn)規(guī)定所處的位置，可以明確網(wǎng)絡(luò)虛擬財(cái)產(chǎn)在立法上確定為權(quán)利客體，且偏向解釋為物權(quán)客體，但由于部分學(xué)者意見(jiàn)激烈，最終《民法總則》中沒(méi)有明確規(guī)定虛擬財(cái)產(chǎn)權(quán)為物權(quán)[1]。（剩余7438字）
