淺談準(zhǔn)確解讀權(quán)利要求，助力提升檢索效率

摘要：文章從《審查指南》專利“保護(hù)范圍”相關(guān)規(guī)定出發(fā)，結(jié)合圖像通信領(lǐng)域特點(diǎn)，選取特定類型的方法權(quán)利要求和實(shí)際案例，針對準(zhǔn)確解讀方法權(quán)利要求的保護(hù)范圍提升檢索效率進(jìn)行淺析。

On Accurately Interpreting Claims to Help Improve Retrieval Efficiency

Abstract： This paper starts from the relevant provisions of the "scope of protection" of the patent in the Guidelines for Examination， combines the characteristics of the image communication field， selects specific types of method claims and actual cases， and analyzes how to improve the retrieval efficiency by accurately interpreting the scope of protection of the method claims.

《專利審查指南（2019版）》（簡稱《審查指南》）第二部分第二章規(guī)定，權(quán)利要求和說明書是記載發(fā)明或者實(shí)用新型及其保護(hù)范圍的法律文件，根據(jù)專利法第五十九條第一款的規(guī)定，發(fā)明或者實(shí)用新型專利權(quán)的保護(hù)范圍以其權(quán)利要求的內(nèi)容為準(zhǔn)，說明書及附圖可以用于解釋權(quán)利要求的內(nèi)容，即以權(quán)利要求的內(nèi)容為準(zhǔn)來確定專利權(quán)的保護(hù)范圍。（剩余4373字）
