商標(biāo)指示性使用問題概述
摘 要:商標(biāo)指示性使用起源于美國的司法判例,并在實(shí)際運(yùn)用中得到廣泛認(rèn)可。我國立法上對商標(biāo)指示性使用沒有明確規(guī)定,且理論研究較為薄弱。通過對商標(biāo)指示性使用的概念進(jìn)行界定,闡述這一制度的合理性及必要性,對這一制度在實(shí)際運(yùn)用中所出現(xiàn)的問題進(jìn)行分析總結(jié),以期對此概念加以明確并運(yùn)用到實(shí)際生活中。

Overview of Indicative Use of Trademarks

Abstract:Indicative use of trademark originated from judicial precedent in the United States and has been widely recognized in practice. There is no clear regulation on the indicative use of trademark in China's legislation, and the theoretical research is weak. By defining the concept of trademark indicative use, this paper expounds the rationality and necessity of this system, analyzes and summarizes the problems in the practical application of this system, in order to clarify this concept and apply it to practical life.
